1. Legal Entity

SpeakHit is operated by Lev K., based in Tel Aviv, Israel. Contact: support@speakhit.app.

2. Acceptance of Terms

By using SpeakHit you agree to these terms. If you don't agree, don't use the app.

3. What SpeakHit Does

SpeakHit is an AI-powered service that creates songs based on your voice or text input. Songs are generated using AI technology. Our platform uses advanced AI models for lyrics writing and music composition.

4. Accounts

• You must provide a valid email or Google account
• You are responsible for your account security
• One account per person
• You must be 13 years or older to use SpeakHit

5. Subscriptions & Payments

• Free plan: 3 songs, no payment required
• Paid plans: recurring monthly subscription via PayPal
• Prices listed on the Upgrade page at time of purchase
• Cancel anytime — your songs remain accessible
• Credits reset monthly for paid plans, unused credits don't roll over
• Payment is processed securely by PayPal, our secure payment processor. SpeakHit does not store your payment details.

Cancellation

• You may cancel your subscription at any time from the app settings
• After cancellation, your plan remains active until the end of the current billing period
• No new charges will occur after cancellation
• Your existing credits remain available until the billing period ends
• Your created songs remain in your library permanently

Refund Policy

• Within 14 days of purchase: You are entitled to a full refund, minus proportional cost of service already used and cancellation fee (5% of purchase price or 100 ILS, whichever is lower), in accordance with Israeli Consumer Protection Law (חוק הגנת הצרכן).
• After 14 days: No refunds. You may cancel your subscription to prevent future charges.
• Special populations: Persons with disabilities, senior citizens (65+), and new immigrants to Israel may cancel within 4 months of purchase, in accordance with Israeli law.
• To request a refund, contact support@speakhit.app within the applicable period.
• Refunds are processed within 14 business days to your original payment method.

6. Song Ownership & Usage

• Songs you create are yours to download, share, and use
• You may use songs for personal and commercial purposes
• SpeakHit retains no ownership of your created songs
• However: songs are AI-generated and may not be copyrightable in all jurisdictions
• You are responsible for how you use the songs
• Do not claim AI-generated songs are performed by real artists

7. Content Guidelines

You agree NOT to create songs that:

• Contain hate speech, harassment, or threats
• Promote violence or illegal activities
• Infringe on others' copyright or trademarks
• Impersonate real artists or celebrities
• Contain explicit sexual content involving minors

We reserve the right to remove content and suspend accounts that violate these guidelines.

8. AI-Generated Content

Songs created on SpeakHit are generated using AI music technology. By using the service, you acknowledge:

• Songs are AI-generated using third-party AI services
• AI-generated songs may not qualify for copyright protection in all jurisdictions
• You receive a perpetual license to use, share, and distribute your songs for personal and commercial purposes (paid plans)
• SpeakHit does not claim ownership of your created songs
• You are responsible for ensuring your use complies with applicable laws
• The quality and style of AI-generated music may vary

Data Handling: Voice and text conversations used to create songs are processed in real-time and are NOT stored after song generation is complete. SpeakHit does not retain recordings of your voice conversations or the text content of your chats. Only the final generated song, its metadata (title, genre, style), and your account information are stored.

AI-Generated Albums

Albums are created using AI technology (Claude for lyrics and planning, Suno for music generation). While we strive for the highest quality:

• Occasional imperfections in lyrics, pronunciation, or musical arrangement may occur
• Each track is individually crafted but results may vary
• You may regenerate individual tracks if not satisfied (1 credit per regeneration)
• Album creation typically takes 10–20 minutes
• Generated music is for personal use. Commercial licensing terms may vary by the AI music provider's policies.
• SpeakHit does not claim ownership of your generated albums. You retain rights to your creative input and descriptions.
• If album generation fails before all tracks are produced, credits for missing tracks are automatically refunded to your account.

Credit & Refund Policy for Albums

• Album creation costs credits based on track count (shown before creation — typically 2 credits per track).
• If album creation fails due to a technical error, credits for missing tracks are automatically refunded to your account.
• Completed albums are non-refundable — credits are not returned if you are unsatisfied with the result.
• You may regenerate individual tracks (1 credit per regeneration) to improve specific songs.
• By clicking "Create My Album" you acknowledge that AI-generated results may vary and accept the credit charge.

9. InspiredHit Feature

• InspiredHit creates songs inspired by an artist's style — NOT covers or copies
• Songs are original compositions, not reproductions
• Using artist names as style reference is for AI guidance only

10. Service Availability

• We aim for 99% uptime but don't guarantee it
• We may perform maintenance with or without notice
• We may modify or discontinue features at any time

11. Account Deletion

• You can delete your account from Settings
• Deletion is permanent — all songs and data are removed
• This cannot be undone

12. Limitation of Liability

SpeakHit is provided "as is". We are not liable for:

• Lost songs or data
• Service interruptions
• Quality of AI-generated content
• How you use the songs you create

13. Changes to Terms

We may update these terms. Continued use after changes means you accept the new terms.

14. Governing Law

These terms are governed by the laws of the State of Israel. Disputes shall be resolved in the courts of Tel Aviv-Jaffa, Israel. Consumer rights under Israeli Consumer Protection Law (חוק הגנת הצרכן, התשמ"א-1981) are preserved and cannot be waived.
